Hiya, You know about the migrate most of the members did to the other forums, and everyones saying Ogaming won't let us use our old titles for threads, and subforums, and forums... ala, Cafe' Asylum, Picture Association thread, even... Why can't we use our old names... We're trying to get as much as a old feel as we possibly can

A person of your age shouldn't be using that language Tark :D, not that I don't agree with the response being BS. But it's a legal thing, it's just easier not to talk to the PCity admins about this place.

I quoted him twice, i have him in aim saying that we wouldn't be sued over forum names (probably, he says) and that all it would be was "un-original"

Would the head of OGaming have anything against citing a contract clause or other legal reference?

I manage an apartment complex. Legalese and binding contracts are my life. And I would gladly tell the OGaming lord and master himself what every lawyer I've met in the business has told me: "If it ain't in writing, it ain't worth squat."

If he doesn't have a document backing him up, then the OGaming tyrant's full of bluffing, bluster and [male bovine feces]. And that means that we could sit here and shout "Beef & Pork Products" all day long, and all he could do was look at us and wring his hands uselessly. Are the forum titles trademarked? I doubt it. Copyrighted? Probably not. Classified material? Nope. Inherent domain registered with any Government body? Not likely. Details of estate? Heh.

And if he doesn't like what we're doing yet he doesn't have any legal backing to move against us, then so what? What's he going to do...fire us? Kick us off the forums? Oh, that's right...we're flipping OGaming a mighty collective middle finger and leaving the OGaming forums like lifeboats from the Titanic. And we're settling in here, where the great and mighty bastards of OGaming have no dominion.

Tell Bogo, Barbarian and his ilk that they can go back to wringing their hands till they're dust. I don't see any reason why we should rightly care what they and the rest of OGaming think.

Why can't we just set it up the way it was before OGaming?

Call it the Spam Factory. Have the Influence Mall and the supergroup threads. Have the Asylum for non-COH stuff. Etc., etc.

I don't see it as much as being sued, as causing trouble.

The mods just don't want to cause trouble, because in the end, it only makes them look bad. It's a lot better to be an adult about it, even if you've got to be more than a little polite and agreeable.

There's also an expression about "don't burn your bridges behind you". :D

Well, since OGaming never had forums with names like The Asylum or The Spam Factory, those were only on the old boards, I don't see what the problem could be. What am I missing here?

Just add the word 'Super' to the beginning of each title. They'll no longer be the same as ogaming's titles and, at the very worst, we'll only have to deal with Marvel's incompetent legal team. ;)

Your previous supplier has absolutely no grounds under US trademark or copyright law to prevent you from using the titles to your folders. Technically, the site retains all rights to creative works produced on their site, but the titles of the folders themselves fall short of the minimum creative element requires to be considered copyrightable material.

In any event, there are no damages that Ogaming can point to that would allow a recovery on their part, so bottom line: Use whatever names for your folders you would like.

I would recommend ignoring any statements in regards to their legal threats about such trivial matters until they send you an official cease and desist letter.

You don't need an attorney to tell you that OGaming's shooting blanks. A humble property manager or anyone else who has to memorize scads of state and federal codes, regulations and other laws will suffice quite nicely. ;)
